Module 4 overview

Module 4 will be tailored to focus on Kenyan specific peer to peer learning, experience sharing and group discussions on opportunities for lawyers in Kenya. This includes strategic planning input in developing human rights policies for businesses, undertaking human rights and environmental impact assessment and due diligence, sustainability and nonfinancial reporting, national and regional policy advocacy, legislative reforms and legal drafting, international development consulting, alternative disputes resolution, strategic litigation, training and capacity building, ESG compliance, transaction advisory, stakeholders/communities engagement  and regulatory compliance.

Module 4 of 4: Peer to Peer Learning

Module 4 will take place as 1-day in person workshop in Nairobi for participants who successfully complete this self-paced e-learning BHR/ESG Course. This peer-to-peer learning and experience sharing session will be facilitated by Kenyan legal experts from leading law firms, Department of Justice, KNCHR, LSK and guest legal expert from DLA Piper Paris office. The tentative date for Module 4 Workshop is 28 or 30 November 2023. The Workshop costs have been sponsored by SIDA through DIHR thus no costs to participants. Those desire to earn a CPD Point will be required to apply and directly to LSK a CPD fee of kshs.1,500.00.  Workshop Programme will be circulated to those who will register to attend.

Upskilling and futureproofing

Our final module will provide you with an understanding of opportunities for lawyers to guide businesses in developing human rights policies, undertaking human rights due diligence, facilitating effective access to remedy and broader implications of the last three modules focus as emerging areas of practice for lawyers. The module will explore local examples and trends in the Kenyan jurisdiction, as well as horizon-scanning future developments to ensure you upskill and futureproof to advise businesses, investors and regulators on emerging areas of practice: BHR, ESG, Sustainability etc.

Community of practice and Practical Tools

After this final module, you will be equipped with knowledge, skills, tools and resources to ensure you are part of leading ESG, BHR and Sustainability lawyers in Africa and to part of thought leaders and champions on implementing a robust BHR, ESG, Sustainability and Responsible Business framework for businesses in Kenya and in Africa. Moreover, you will be part of ongoing mentorship, network and community of practice of like-minded legal professionals advocating for responsible business practices in Kenya and in East Africa. .

Özgür Kahale

Pro Bono Director | Paris 

Özgür is an international lawyer and a scholar of corporate responsibility with a focus on business and human rights. She has an LL.M from Essex University in International Human Rights Law and a Ph.D. from Lancaster University in International Investment and Protection of Human Rights. She worked as a project finance lawyer in London and Paris before joining the Pro Bono team. She is the Pro Bono Director for Europe managing a high-volume pro bono program in 17 countries serving more than 2000 attorneys. The Firm's European Pro Bono Practice provides free legal assistance to key European NGOs, United Nations agencies, social entrepreneurs, academic institutions and disadvantaged individuals.

Claris Kariuki - Mwirigi

Claris Kariuki - Mwirigi is an advocate with 12 + years of experience in Human Rights Law, Public Policy Formulation and Legal Research. She holds a Master of Law Degree in Public International Law from the University of Nairobi, Kenya. She has previously worked as an assistant lecturer at Mount Kenya University School of Law teaching diverse units for diploma and degree courses. She is currently a Senior State Counsel at the Office of the Attorney General & Department of Justice in Kenya where she serves amongst other roles as the focal point person on matters business and human rights. 

 
 
 

FCS Catherine Musakali, LL.B, LL.M, FCPSK  

Catherine Musakali is an Advocate of the High Court of Kenya and a Fellow of the Institute of Certified Secretaries of Kenya.  Catherine is the Founder of Dorion Associates LLP, a firm specializing in governance matters and commercial legal consultancies. Prior to founding Dorion Associates, Catherine worked for Kenya Shell Limited (Now Vivo Energy Kenya Limited) as their Company Secretary and Head of Legal for over fifteen years, during which period she managed the Legal Functions of Shell operations in Kenya, Uganda, Tanzania, Sudan, Eritrea, Ethiopia, Morocco, Egypt and Tunisia. She has worked for Shell in the United Kingdom during which period she specialized in Mergers and Acquisitions and other commercial transactions as well as being the Legal Focal Point for all Contracting and Procurement matters for its businesses in the 23 Countries in Africa. Before this she set up and managed the Legal department of UAP Provincial Insurance Limited during which period she represented her employer in the Industry body, the Association of Kenya Insurers (AKI). Catherine was, until May 2014, the Chair of the Institute of Certified Public Secretaries of Kenya (ICPSK) and has also served as the Chair of its Education and Professional Development Committee as well as the Legislation and Corporate Governance Committee. She also sat on the Council of the Corporate Secretaries International Association, which is a global body bringing together governance professionals. She is a founder and Chair of The Women on Boards Network and is currently the Company Secretary of a number of Companies and sits on various Boards including those in the public and private sectors. She has previously served as a Director at Nairobi Securities Exchange, Association of Kenya Insurers (AKI) and was at one time the Chairman of Kenya Seed Company Limited. She also serves as a member of the Capital Markets 10 year Master Plan Implementation Committee. Catherine has been the Chief Judge, Corporate Governance, FiRe Awards and is a trained Corporate Governance Trainer, Governance Auditor and Board Evaluator and has developed policies on governance for a number of institutions. She also consults for the IFC. Catherine holds a Bachelor of Laws Degree and a Master of Laws Degree from the University of Nairobi, a Higher National Diploma in Law (Kenya), as well as a certificate in Securities and Investment from the Securities and Investment Institute (London). 

 
 
 

Cyrus M. Maweu 

Cyrus M. Maweu holds a Bachelor of Laws (LL.B) Degree from the University of Nairobi, a Post Graduate Diploma in Law from the Kenya School of Law and a Masters of Arts Degree in Development and  Governance from the University of Duisburg-Essen, Germany. He is a legal practitioner with diverse experience in the human rights and social justice sector. Has worked extensively with National Human Rights Institutions, Civil Society Organizations and the public in receipt and processing of human rights complaints including the
provision of appropriate legal advice, investigations,
research and advocacy. Mr. Maweu has been involved in constitutional and human rights litigation and has successfully handled strategic Public Interest Litigation cases in Kenya. A certified International Criminal Investigator and a Certified Professional Mediator with a wealth of experience in legal research, litigation and trial advocacy as well as the application of Alternative Dispute Resolution mechanisms. He is currently a member of the National Steering Committee for the Implementation of Alternative Justice Systems in Kenya and the Implementation Committee for the National Action Plan on Business and Human Rights in Kenya. Mr. Maweu has in the past represented the KNCHR in the Taskforce appointed to advise on of the Ogiek of Mau case.

 
 
 

Dr Victor Lando

Dr Victor Lando is an Advocate of the High Court of Kenya with a Bachelor of Laws (LL.B) degree from the University of Nairobi, a Master of Laws (LLM) degree in Human Rights and Democratisation from the University of Pretoria and a Doctor of Laws (LLD) degree, also earned from the University of Pretoria. He is a Member of the Chartered Institute of Arbitrators, the International Commission of Jurists (ICJ) Kenya and the Law Society of Kenya.

He has over fifteen years’ experience in the legal sector with a specialty in human rights, regional integration within the EAC Treaty framework, humanitarian and refugee law as well as constitutional law, technology law and intellectual property law. Dr. Lando has served in several reputable organisations including the Kenya National Commission on Human Rights (KNCHR), the International Rescue Committee (IRC) and the United Nations High Commissioner for Refugees (UNHCR). He has consulted for institutions such as the National Gender and Equality Commission of Kenya (NGEC), the Kenya National Commission on Human Rights (KNCHR), the United Nations High Commissioner for Refugees (UNHCR), the International Rescue Committee (IRC), the Society for International Development (SID) and the CRADLE –the Children’s foundation. He also serves as a human rights expert within the UNDP’s panel of experts and has written extensively on the subject of regional integration, human rights and good governance. Dr. Lando currently serves as the Dean, Riara Law School, Nairobi, where he teaches among others, Constitutional Law, Public International Law , Human Rights Law , Criminal Law as well as Legal Research and Writing. He is also the Managing Partner at Lando, Law, LLP, a bespoke full service law firm in Nairobi majoring in technology law and policy, human rights, real estate law, succession and estate planning as well as arbitration.
